Proposed Mining Amendment Regulation 2022

The draft of the proposed Mining Amendment Regulation 2022 is now available for public comment. The proposed Regulation will support the Mining and Petroleum Legislation Amendment Act 2022, which was passed by both Houses of Parliament on 17 May 2022 and assented to on 6 June 2022.

Object of the Proposed Regulation Amendment

The objects of the proposed Regulation (PDF, 898.62 KB) are to enable faster and more efficient decision-making, streamline and modernise processes, improve clarity, enhance compliance, allows for hydrogen and non-metals to be regulated under the Mining Act 1992 and makes other miscellaneous amendments to the Mining Regulation.

The objects of the Regulation include amendments to update the definitions for the purposes of the prescribed standard conditions of mining leases. The prescribed conditions broadly relate to rehabilitation of land within mining leases, risk assessments, management plans and other obligations associated with the rehabilitation of the land. The updated definitions will clarify the application of the conditions to ancillary mining activities on land that is outside the mining area of a mining lease.

The object of the Regulation also includes providing for the calculation methods of administrative levies and late payment fees. The relevant provisions and calculation methods substantively reflect the existing provisions in the Mining Act 1992 with minor amendments to update terminology and ensure clarity.

Proposed Petroleum (Onshore) Amendment Regulation 2022

The draft of the proposed Petroleum (Onshore) Amendment Regulation 2022 (PDF, 178.05 KB)is now available for public comment. The proposed Regulation will support the Mining and Petroleum Legislation Amendment Act 2022, which was passed by both Houses of Parliament on 17 May 2022 and assented to on 6 June 2022.

The object of the proposed Regulation is to define the ‘well-head’ of petroleum, which may be used in the calculation of royalties under the Petroleum (Onshore) Act 1991 and the Regulation.
